Over the past few decades, thousands upon thousands of people have moved to the U.S. in hopes of starting a new, better life. One aspect of starting a better life is getting a job. This can be extremely difficult for some people who are about to or who have recently entered the U.S. Thankfully, there are a number of employers in the U.S. that are more than happy to hire foreign workers. However, before an employer can start hiring these foreign workers, there are a number of things that have to be taken care of beforehand. This will prevent the business from getting into any legal or ethical issues in the future.
PERM Advertising Requirements
Any business in the Bay Area that is looking to hire foreign workers need to do some research on the PERM advertising requirements. These requirements are a list of extremely in-depth rules that an employer must follow when hiring foreign workers. Some of these rules are related to wage determination, equality, and eligibility. Only by following these rules can an employer legally hire a foreign worker.
Form 1-9 is a piece of documentation that must be filled out on a foreign worker’s first day. Form 1-9 is a multistep process that allows an employer to learn the work authorization of the employee. The employee must fill out detailed personal information such as name, date of birth, address, immigration status, etc. This part of the process is called Section 1. Once this has been filled out, it is the responsibility of the employer to fill out Section 2. This part of the process requires the business owner to examine and verify the documents. If the documents meet the standards of the employer, then he or she will sign it and keep it for their personal records. This process certifies the employee is authorized to legally work.
However, it is important to remember that an employer needs to keep the Form 1-9 for at least one after the employee has left the workplace or three years since the initial hiring date. This will minimize the chances of legal or authorization issues down the road.
Many citizens of war-torn or third world countries often dream about moving to the U.S. to start a new life. Thankfully, some of these individuals get to make the journey and get a fresh start. However, one of the first steps of this fresh start is getting a job. As an employer, it is important to be prepared for hiring foreign workers. Be sure to do some research on the PERM advertising requirements and Form 1-9.
