What Is PERM Advertising?
PERM advertising is the recruitment process an employer generally conducts before filing an Application for Permanent Employment Certification with the U.S. Department of Labor.

The purpose of this recruitment is to test the U.S. labor market for able, willing, qualified and available U.S. workers for the offered position. The employer must conduct the required recruitment, consider applicants appropriately and retain supporting documentation.

Under the basic labor certification process described in 20 CFR § 656.17, recruitment for many PERM cases includes mandatory steps. Professional occupations also generally require three additional recruitment steps.

State Workforce Agency Job Order
A job order is generally placed with the State Workforce Agency serving the area of intended employment for a period of 30 days.

Sunday Newspaper Advertising
PERM recruitment generally requires advertisements in two different Sunday editions of the newspaper of general circulation serving the area of intended employment that is appropriate for the occupation and workers likely to apply. For a rural area without a newspaper that publishes a Sunday edition, the applicable regulation provides for use of the edition with the widest circulation in the area of intended employment.

What Must a PERM Advertisement Include?
Newspaper and professional-journal advertisements used in the basic PERM recruitment process must satisfy the applicable content requirements of 20 CFR § 656.17(f).
Among other requirements, an advertisement must generally:
Identify the employer
Tell applicants where or how to submit a résumé or application
Describe the position sufficiently to inform U.S. workers of the job opportunity
Identify the geographic area of employment with adequate specificity
Disclose applicable travel requirements
Avoid stating a wage below the prevailing wage
Avoid including duties or requirements that exceed those listed in the PERM application
Avoid offering wages or employment terms less favorable than those offered to the sponsored worker
