Here are the important things you need to know about PERM advertising requirements in the Bay Area and how you can successfully hire foreign labor if they are the more suitable choice for your company.
1. Put up a job order
As the hiring company, the first thing you need is to put up a job order and this should be properly done in the state where you are doing the hiring. This means that if you will be hiring people in California, you should put up the job order in the state of California and not in any other state for it to be legitimate. There is a 30-day rule applied to a job order and this is counting the weekends as part of the 30-day run.
2. Publish ads
Now that you have a job order in place, you can launch ads on different media channels. However, there are ads that are required, which means even if you plan to use specific media channels, you need to publish ads on the required channels. These include publishing ads on two Sunday version of a local newspaper. If the state where the job order is placed doesn’t have a local paper with Sunday version, you need to publish ads on a newspaper with the biggest circulation.
3. Internal ad publication
On top of the ad that you placed on a Sunday version of a local newspaper, you need to have a Notice of Filing (NOF), which is an internal ad post. This is an ad posting inside your company that will be made available for at least 10 consecutive days. There are rules that govern the NOF so make sure to adhere to those including the proper language used to have an effective internal ad.
4. Use other recruitment channels
Now that you’ve published ads internally and with a local newspaper, you can utilize three additional ways to hire foreign labor. Some of the most common ways include taking part in job fairs, publishing a job post on job sites, hiring a recruitment agency, and publishing a job post on TV and radio.
